Consent to Receive Advertising and Marketing Messages

for IE "Berdyugin AE" (Republic of Kazakhstan)

This Consent (hereinafter referred to as the "Consent") regulates the procedure for the User to receive advertising, informational, and marketing messages from the Operator of the SaaS service QR‑CMS (hereinafter referred to as the "Service").

The Consent is drawn up in accordance with the legislation of the Republic of Kazakhstan, including:

  • The Law of the RK "On Advertising"
  • The Law of the RK "On Personal Data and Their Protection"
  • The Law of the RK "On Communication"
  • The Law of the RK "On Protection of Consumer Rights"

1. General Provisions

The User provides the Operator with voluntary consent to receive advertising, marketing, and informational messages related to the operation of the Service.

Consent is separate from the consent to the processing of personal data and can be revoked at any time.

Messages may be sent by email, through messengers, SMS, push notifications, and other communication channels specified by the User.

2. Purposes of the Mailing

The Operator has the right to send the User messages containing:

  • news and updates of the Service;
  • information about new features and capabilities;
  • special offers, promotions, and discounts;
  • educational materials, instructions, recommendations;
  • notifications about events, webinars, and training sessions;
  • surveys and research to improve the quality of services.

3. Personal Data Used for the Mailing

To send messages, the following may be used:

  • email address;
  • phone number (if available);
  • User's name;
  • account data;
  • information about the tariff and use of the Service.

Data processing is carried out in accordance with the Privacy Policy.

4. Procedure for Providing Consent

Consent can be provided:

  • upon registration in the Service;
  • upon subscription;
  • when filling out a form on the website;
  • when confirming email;
  • by activating a checkbox or a "Subscribe" button.

Consent is considered provided from the moment of confirmation by the User.

5. Right to Opt-out of the Mailing

The User has the right to opt-out of receiving messages at any time:

  • via the "Unsubscribe" link in the email;
  • through account settings;
  • by sending a request to the Operator's email;
  • by other methods provided by the Service.

Opting out of the mailing does not affect the possibility of using the Service.

6. Restrictions and Guarantees

The Operator undertakes:

  • not to transfer contact data to third parties for their own mailings without the User's consent;
  • not to use the mailing for spam or intrusive advertising;
  • to comply with the requirements of the legislation of the RK on advertising and personal data.

7. Responsibility of the Parties

The Operator is responsible for the correctness and legality of the messages sent.

The User is responsible for providing up-to-date contact data.

The Operator is not responsible for the impossibility of delivering messages for reasons related to the communication operator, postal service, or User settings.

8. Period of Validity of the Consent

Consent is valid until its revocation by the User.

After revocation, the mailing ceases within 3 working days.

9. Change of the Terms of the Consent

The Operator has the right to change the terms of the Consent.

The new version comes into force from the moment of publication on the website.

Continued use of the Service means agreement with the updated terms.

Exceptions

Transactional and system messages necessary for the functioning of the Service are not considered within this Consent and do not require separate User consent. Such messages include, but are not limited to:

  • password recovery requests;
  • email address confirmation;
  • notifications about automatic tariff renewal;
  • other mandatory service notifications.

These messages are sent to the User regardless of whether there is consent to receive advertising and marketing messages and are mandatory to ensure the correct operation of the Service.

10. Final Provisions

Consent is governed by the legislation of the Republic of Kazakhstan.

All disputes are resolved in accordance with the current legislation of the RK.

Consent is part of the legal documentation of the Service.
